What options do you have?

The two main types of bankruptcy for consumers are Chapter 7 and 13. You will need to take a bankruptcy means test to find out what type you qualify for. It is a basic test that compares your personal income to that of the general population in your state. Should your income be below the guideline, you qualify for Chapter 7 (debt liquidation). This particular option is there mainly for people who do not have an income and those who do not earn anything.

Chapter 13 is considered to be the “debt reorganization” bankruptcy. With this type, your debts will be reorganized so that you only end up paying one monthly amount that you can comfortably afford. This new payment arrangement will be paid directly to your bankruptcy trustee, who will then pay your creditors for you out of the monthly amount they receive from you. A Chapter 13 repayment plan lasts for 3-5 years. It depends on how much you earn and what amount of disposable income you have, but you could possibly end up paying everything or just a portion of the debt back. This is also the solution for people who are at risk of facing foreclosure on their homes, but who want to remain living in their home without worrying that the bank will take their home.

What if filing for bankruptcy is not for you?
